Virginia Attorneys' Divorce Electronic Reference
Virginia Attorneys' Divorce Electronic Reference (VADER) is the premier software for domestic relations practice in Virginia, serving attorneys, courts, mediators and others.
VADER is an extensive compendium of automatically calculating workbooks, including Support and Support-related worksheets, Equitable Distribution workbooks and Case Tracking worksheets. VADER also includes contributed model text documents from local jurisdictions and others.

VADER provides a set of tools that will help you prepare a divorce case in Virginia. It is a collection of Microsoft Excel template workbooks with 52 worksheets and associated example worksheets. The examples illustrate use of the templates. These worksheets enable you to calculate automatically the increasingly complex requirements of Virginia law, and to obtain attractive, informative documents to present to others. VADER also contains contributed model text documents.

 SUPPORT AND SUPPORT-RELATED WORKBOOKS
VADER's support worksheets automatically calculate guideline child and/or spousal support for any level of combined income in accordance with all current Virginia Code provisions.

Support (the Support workbook) calculates statewide pendente lite spousal support guidelines for Juvenile Court cases under Virginia Code §16.1-278.17:1, as well as circuit court guideline amounts for multiple Virginia jurisdictions. It contains the following worksheets:

  • 1 worksheet that calculates sole custody child support;
  • 2 worksheets that calculate sole custody child support and guideline spousal support;
  • 2 worksheets that calculate only guideline spousal support, for cases not involving child support (About Spousal Support);
  • 1 worksheet that calculates split custody child support.
  • 1 Instant Arrearages worksheet, which calculates the support arrearages when support is ordered but not implemented immediately

Shared (The Shared Custody Child Support workbook) contains four worksheets:

  • A shared custody worksheet that calculates child support in a shared custody situation;
  • An automatically generated worksheet that calculates sole custody child support for comparison;
  • A summary worksheet that compares the shared custody guidelines with the sole custody guidelines, as required by law.
  • An Instant Arrearages worksheet, which calculates the support arrearages when support is ordered but not implemented immediately

C9Support (the Support workbook created especially for the Ninth Judicial Circuit of Virginia) contains the following worksheets:

  • A worksheet that calculates Ninth Circuit guideline spousal support;
  • A worksheet that calculates Ninth Circuit guideline spousal support with adjustments for family debt;
  • A worksheet that calculates Ninth Circuit guideline spousal support, and child support, with an adjustment for family debt.

Other support-related workbooks include the following:

  • 2 Income and Expense Statements;
  • Arrears (a flexible and expandable workbook for calculating support arrears);
  • Additional Factors (a worksheet that permits the user to list factors for the court to consider in arriving at a support determination);
  • Exempt (a worksheet that calculates the value of child-related exemptions and tax credits for each party);
  • Medical (a worksheet for tracking responsibility for unreimbursed medical expenses incurred by the minor children).

 EQUITABLE DISTRIBUTION
VADER provides three workbooks for use in cases involving equitable distribution which will help you to prepare to settle or present your case:

EDForms (schedules for presenting an equitable distribution case) contains the following worksheets::

  • PersInfo (a personal information schedule with relevant dates and information regarding each party)
  • PersProp (a schedule that permits a comprehensive listing of personal property in a given case)
  • Business (a schedule that reflects ownership interests in business assets, such as corporations)
  • Stocks (a schedule that tracks ownership shares and values in securities)
  • RetFunds (a schedule that tracks ownership shares and values in retirement assets such as IRAs and 401(k)s)
  • Pension (enables the user to list ownership shares and values of defined benefit retirement plans)
  • Debt (for listing credit card and other debt)
  • Summary (totals values and categorizes information from the other schedules in ED Forms, providing an easy to use summary of all assets in the case)
  • Proposed (permits the user to propose different distributions of summarized property)

EDFunds (a workbook that calculates ownership shares of hybrid property) contains the following worksheets:

  • PersInfo (a personal information schedule with relevant dates and information regarding each party)
  • SOFCalc (calculates the marital and separate values and shares of hybrid real estate)
  • Refi (calculates the marital and separate values and shares of hybrid real estate when the property has been refinanced)
  • MarFund (calculates marital and separate values and shares of a 401(k) or similar fund started during the marriage and continued after the separation)
  • GenFund (calculates marital and separate values and shares of a 401(k) or similar fund started before the marriage, and maintained during the marriage and after separation)

Options (a workbook that analyzes values and shares of hybrid stock options) contains the following worksheets:

  • ReadMe (information on the use of the workbook)
  • MaritalShares (for calculating separate and marital interests)
  • Distribution (for use whenever shares are sold)

 VADER SUPPORTED TRACKING SYSTEMS AND TEXT FILES
Divorce Case Tracking Systems
VADER calculates deadlines and due dates generated by scheduling orders in Fairfax County and the greater Richmond area. It serves as a useful tool for tracking dates and preparing your case, regardless of your geographic location.

VADER Text Files
VADER’s model text documents are contributed documents and generally are model text forms adopted and approved for use in local jurisdictions in Virginia. Sensei Enterprises, Inc. distributes these documents as a courtesy and takes no proprietary interest in them.

Most model orders contain the jurisdiction name in the title. With this exception and absent specific local requirements to the contrary, all documents can be used as is throughout Virginia. VADER includes the following text documents:

  • Revised model Child Support Orders and model Income Withholding Order with currentnotice requirements of §20-60.3, 20-79.3.
  • Model Decree of Divorce (approved - Fairfax County)
  • Model Spousal Support Order (approved - Fairfax County)
  • Addendum for Protected Identifying Information – Confidential (Virginia Supreme Court)
  • Recently revised model Discovery for Divorce/Support/E.D. - Interrogatories and Production of Documents (approved - Fairfax County)
  • For assistance in distributing Federal pensions, the entire text of OPM’s Handbook for Attorneys, used for providing court orders acceptible for processing by OPM for Federal Civil Service Retirement in pdf form.
  • Model Support Orders and Parent Education Referral Order (with language specific to York County, Virginia)

What does VADER stand for?

What does the current VADER contain?
The current, shipping version of VADER is version 2009.x. It contains Excel worksheets, including templates, ReadMe worksheets, tables and examples. The two main types of worksheets are support or support related worksheets and equitable distribution worksheets. VADER also includes many contributed text files, such as model orders, model discovery, model proffers, etc.

What do I need to run VADER?
You need a Macintosh or Windows computer, Microsoft Excel, and to open the text documents, you need word processors that can read Microsoft Word or WordPerfect files; the pdf files open in Preview (Mac) or Adobe Acrobat. To make use of all of the worksheets and the automatic, embedded calculations, you need Microsoft Excel 97 or later. Be advised, however, that Microsoft Excel 97 is twelve years old and no longer supported by Microsoft.

As of January 2009, the latest version for the PC is Excel 2007, which is in Microsoft Office 2007. Excel runs on PC compatible computers under Microsoft Windows. Newer versions of Excel may require newer versions of Windows. Check the specifications on the box to know what versions you need. The TrueType fonts used with the Windows versions of VADER files, are usually included in Windows.

For Macintosh computers, the latest version is Excel 2008 in Office:Mac 2008. However, this version of Excel for the Macintosh does NOT have Visual Basic for Applications support, which is a requirement for the operation of VADER 2009. Excel 2004 for Mac IS compatible with VADER and Microsoft has announced that the next version of Excel for the Mac will have VBA support. Excel 98, in Office 98, is the earliest supported version on the Mac.

Sensei does NOT recommend the use of VADER with spreadsheet programs other than Microsoft Excel. We cannot warrant that the calculations will be the same in one spreadsheet program as the other.

Our text files are formatted for Microsoft Word (Mac and PC) and Word perfect (on the PC). While other word processing programs may be able to open files created by Word or WordPerfect, converting the formatting to your word processing program may be difficult. (Word is much better at exporting and importing than is WordPerfect.)

Do I need to install VADER?
No, you can operate directly from the CD, but most people choose to copy VADER to their hard disk or network server.

Where is the Installer program?
There is no installation program for VADER. The installation procedure is to copy the single VADER folder from the CD-ROM to your hard disk or network server. See the Using VADER manual, pages 2 – 5.

Why are macros disabled on my new computer?
Microsoft disables macros by default in hopes of avoiding some viruses. VADER needs macros to provide functionality. To fix the problem, set security to low.


 FREQUENTLY ASKED QUESTIONS – LEGAL

Does VADER support the Colorado method for crediting support for children of other marriages?
Yes, all child support worksheets in the Support folder allow you to deduct a guideline amount, as specified in §20-108.2.C (2001) from income for child(ren) of other marriages supported in the home or to deduct actual child support paid by the non-custodial parent.

Do VADER worksheets support the latest amendments to the Virginia Child Support Guideline?
Yes, VADER is current with all amendments through the end of 2009.

What legislation has recently affected VADER worksheets?
This year and every year, the numbers for the poverty exception to shared support, which are tied to the Federal Poverty Guidelines change. This affects the Shared worksheet. In addition, the Value of the Exemptions worksheet is tied to Federal tax law and changes every year.
